321 Annexation Right of Way Mossman13? TOWN OF YELM ORDINANCE NO. 321 AN ORDINANCE providing for the annexation of certain contiguous property to the Town of Yelm, Washington. WHEREAS, pursuant to the method of annexation for municipal purposes provided by RCW 35.13.180, the Town Council and the Mayor of the Town of Yelm have determined it appropriate to annex for use as public road, certain real property more particularly described hereinbelow, which is contiguous to a boundary of the Town of Yelm; and WHEREAS, said real property is presently a part of the public road system of the State of Washington; and WHEREAS, the Thurston County Boundary Review Board has declined to invoke jurisdiction over said property, and, WHEREAS, the State of Washington has given its written consent to said annexation, NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF YELM, THURSTON COUNTY, WASHINGTON, as follows: Section 1. The following described real property situateT'1.n TFurston County, State of Washington, to -wit: That portion of the 100 foot Right of Way of Secondary State Highway No. 507 lying East- erly of the East margin of Mill Street extended Northerly and Westerly of the existing town boundary limits of the Town of Yelm at Mosman Street, all located in the Southwest quarter of the Southwest quarter of Section 19, Township 17 North, Range 2 East, W. M. being contiguous to the Town of Yelm, Washington, and not being a part of any incorporated city or town of the State of Washington, be and the same is hereby annexed to the Town of Yelm. Section 2. The real property described in Section 1 of this Ordinance shall be and become a part of the Town of Yelm as provided herein on the effective date of this Ordinance and shall be subject to all laws and ordinances of the Town of Yelm now or hereafter in force, and in the event said area shall ever cease to be used as a public roadway, then in such event said area shall be subject to the existing indebtedness of the Town of Yelm and, if ever applicable, shall be assessed and taxes at the same rate and on the same basis as other property within the corporate limits of the Town of Yelm is assessed and taxed. 13;3 Section 3. The Clerk of the Town of Yelm be, and he is hereby directed to record a copy of this Ordinance in the office of the Auditor of Thurston County, Washington, and to file a certified copy hereof with the Board of County Commissioners of Thurston County, Washington.
