AN ORDINANCE providing for the annexation of certain contiguous property to the Towncof Yelm, Washington; declaring an emergency, and making the ordinance effective immediately upon passage. BE IT, AND IT IS HEREBY ORDAINED BY THE COUNCIL OF THE TOWN OF YELM, as follows: j Section 1. On the 12 day of September 1973 there was filed with the J Council and the Mayor of e Town of Yelm, Washington, a notice of intent to commence proceedings for the annexation of the Town of Yelm of the real property hereinafter described pursuant to the petition method provided by RCW 35.13.125, 35.13.130, 35.13.120, 35.13.150, 35.13.160, and 35.13.170, which notice was sighed by the owners of more than ten per cent (10%) in value, according to the assessed valuation for general taxation, of said real property. ,Section 2. That pursuant to said notice, the council adopted a resolution fixing the 10 day of October 1973 at 8:00 o'clock P.M. at the Town Hall, Yelm, Washington, as the timeace for a meeting with the parties signator to said notice for the purpose of discussing and determining the matters set forth in RCW 35.13.125. Section 3. At the meeting held on the said 10 day of October 1973 , the Mayor and Council of the Town of Yelm met with the said initiating g parties and considered the matters provided for in RCW 35.13.125 and determined that there is no libility of the Town of Yelm on general obligation bonds, the liability for which should be extended to the area proposed for annexation, and that the Tcwn of Yelm had not adopted a comprehensive plan extending over the area proposed for annexation, and that accordingly there should be no- requirement that provisions x with respect to said matters be included in the proposed petition for annexation and the Council .further made its preliminary determination that it would accept the proposed petition for annexation. Section 4. Pursuant to the determinations made at said meeting, a petition for the annexation of such real property to the Town of Yelm was circulated, and L_ said petition was filed with the Council of the Town of Yelm on the 12 day of Se tember , 1973. That the Council of the Town of Yelm determine that said .i3`on complied in all respects with the provisions of RCW 35.13.130 and directed that the 10 day of .Oct�ober.� 1973at 8:00 o'clock P.M. at the Town Hall, Yelm, Washington, be fixed as eth time and place for a public hearing on said petition for annexation and inviting all interested parties to appear at said hearing and voice their approval or disapproval of the petition For annexation, and directing that notice of such hearing be given by publication in the Nisqually Valley News, the official newspaper of the Town of Yelm, and by posting three copies of such notice in three public places within the area proposed for annexation. Section 5. That the said notice of hearing on the petition for annexation was posted in three public places within the area proposed for annexation and published in one publication of the Nisqually Valley News, as appears from the affidavits of posting and of publication filed with the Council of the Town of Yelm. Section b. That a hearing was regularly held at the time and place fixed in said notice in the manner provided by law, and all interested parties were heard with respect to the proposed annexation. Section 7. That the following portions of Thurston County, State of Washington, to -wit: that portion of Section 18 & 19 Twp 17N a Rg e 2 E described as follows: Beginning at the intersection of the Fast Line of Coates Rd with the Crystal Springs Rd; thence North along said east line of Crystal Springs Rd to it's intersection with Yelm Creek; thence northwest along the center line of said creek to it's intersection with the North line of the South one -half of the Southwest one o,!.gtart6nu6&wth6 Southwest one - quarter of Section 18 TWp 17 North, Rge 2 E;, thence Fast to the interesection of the North line of the of the South one -half of the S] - SW 14 with the westerly right of way line NW �4 of the County Rd known as Rhoton Rd; thence southerly along said westerly right of way line to its' interesection with the North lin of the South one -half of the southeast one - quarter of'Seo TWp 17N, R2E; thence westerly along. said north line to the Easterly right 242- of way line of Crystal Springs Rd; thence southerly along said easterly right of way line to the point of beginning. of any incorporated city or town of the State of Washington, be, and the same is hereby annexed to the Town of Yelm. Section 8. That the said real property shall be and become a part of the Town of Yelm effective on the date and time of the adoption of this ordinance and that said area shall be subject to all laws and rr dinances of the Town of Yelm then and thereafter in force. That a copy of this ordinance be recorded by the Clerk of the Town of Yelm with the Auditor of Thurston County, and that a copy hereof be filed with the Board of County Commissioners of Thurston County in compliance with the provisions of RCW 35.13.150. i Section 9. This ordinance is necessary for the immediate preservation of the public health, welfare and safety of the Town of Yelm, Washington,, and its existing public institutions and shall take effect immediately upon its passage.
