412 1991 Uniform Mechanical Codej001 CITY OF YELM ORDINANCE NO. 412 AN ORDINANCE of the City of Yelm adopting the 1991 edition of the Uniform Mechanical Code, 1991 Edition regulating and controlling the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of heating, ventilating, cooling, refrigeration systems, incinerators, or other miscellaneous heat - producing appliances in the City of Yelm; providing for the issuance of permits and collection of fees therefore; repealing Ordinance No. 314 of the City of Yelm and all other ordinances and parts of the ordinances in conflict therewith. THE CITY COUNCIL OF THE CITY OF YELM, THURSTON COUNTY, WASHINGTON DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. That certain documents, three (3) copies of which are on file in the office of the City Clerk and the City of Yelm being marked and designated as a Uniform Mechanical Code, 1991 Edition, including Appendix Chapter A thru D, published by the International Conference of Building Officials, be and is hereby adopted as the code of the City of Yelm for regulating the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of heating, ventilating, cooling, refrigeration systems, incinerators or other miscellaneous heat - producing appliances in the City of Yelm providing for the issuance of permits and collection of fees therefore; and each and all of the regulations, provisions, conditions and terms of such Uniform Mechanical Code, 1991 Edition, published by the International Conference of Building Officials, on file in the office of the Yelm City Clerk are hereby referred to, adopted and made a part hereof as if fully set out in this ordinance. SECTION 2. It shall be unlawful for a person, firm or corporation to erect, construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use or maintain mechanical systems or equipment or cause or permit the same to be done in violation of this code. SECTION 3. That Ordinance No. 314 of the City of Yelm adopting the Uniform Mechanical Code, 1985 Edition and all other ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That if any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The Yelm City Council hereby declares that it would have passed this ordinance, and each section, subsection, clause or phrase thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses and phrases be declared unconstitutional.
