06-25-13 MinutesYELM CITY COUNCIL REGULAR MEETING TUESDAY, JUNE 25, 2013 MINUTES 1. Mayor Harding called the meeting to order at 6:00 p.m. 2. Roll Call Present: Bob Isom, Mike McGowan, Tracey Wood, Ken Garmann and Russ Hendrickson. Absent: JW Foster, Joe Baker 3. Agenda Approval 13-49 MOTION BY TRACEY WOOD APPROVING THE AGENDA AS PRESENTED. CARRIED. 4. Special Presentations - no scheduled 5. Public Comment - Kyle Phillips, White Horse business owner returned to address Mayor and Council to discuss gambling taxes imposed by the City of Yelm. Provided RCW reference allowing imposition of taxes and referenced City of Yelm Municipal Code passage in 1975 of the rates adopted. Tax rates have remained the same while other costs have increased cutting his profits. Mr. Phillips proposed amendment to the Code to allow business owners to deduct payouts from the taxable amount to keep customers, employees and gambling games in his establishment in Yelm. Mayor Harding responded that business is not without costs associated with public safety. Directed staff to provide copies of handouts to Council. 6. Consent Agenda Minutes - Regular Meeting June 11, 2013 Payables - Checks #60545-60611 Totaling $177,230.06 Yelm City Park, LINKED, First Baptist Church Family Fund Day, July 20, 2013, open to the public. Public Hearing - none scheduled 8. New Business - a. Pavement Preservation Project, Lakeside Industries 2013 Contract Award The City of Yelm was successful in competing for funding from Transportation Improvement Board for overlay to extend the asphalt of failing roadways based on functional classification, existing pavement condition, and type of route, sidewalk maintenance and ADA compliance. The City's required match for this grant application of $423,190 is $47,021. Stephanie Ray presented results of call to bid for paving preservation project on three projects: Bald Hills Road, Cullens Road and Burnett Road. Lakeside was the low responsive bidder at $299,748.50 for 2" asphalt overlay. With the current bid price, the City's contribution is lowered to $38,615, TIB grant of $347,540 for a total project cost of $386,155, including design and construction management. Page 1 of 3 13-51 MOTION BY BOB ISOM AUTHORIZING MAYOR HARDING TO SIGN A CONTRACT WITH LAKESIDE INDUSTRIES IN THE AMOUNT OF $299,778.50 FOR CONSTRUCTION SERVICES RELATED TO THE CITY'S 2013 PAVEMENT PRESERVATION PROJECT BALD HILLS ROAD; CULLENS ROAD; BURNETT ROAD. CARRIED. b. Ordinance No. 973 Updating Yelm Comprehensive Plan, Capital Facilities Chapter Grant Beck, Community Development Director, presented the Capital Facilities Project List reviewed and recommended by the Planning Commission as presented at Public Hearing on June 17, 2013. The 10 -year short-term and 20 - year long-term needs list was derived from the 2008 Parks Plan, 2009 Transportation Plan, 2009 Water System Plan and current draft of the General Sewer Plan. The projects identified on the Capital Facilities are not new, but are stated from adopted or draft capital facilities plans. Additions to the list include update to Yelm City Park and community center, the SW 1A Well project and treatment, storage and water distribution upgrades and sewer system short- term improvements and facilities planning. The Growth Management Act requires the City's Comprehensive Plan to include a capital facilities chapter to establish goals and policies related to infrastructure needs of the community tying land use to facility use. The items are not weighted by priority, but are listed by category. 13-52 MOTION BY BOB ISOM ADOPTING ORDINANCE NO. 973 UPDATING THE YELM COMPREHENSIVE PLAN CAPITAL FACILITIES CHAPTER WITH AN UPDATED CAPITAL FACILITIES PROJECT LIST. CARRIED. c. Interlocal Agreement with Thurston County District and City of Yelm Tracie Rice, Court Administrator, provided staff a report on the fees associated with conducting jury trials on Yelm cases in Thurston County District Court. The interlocal agreement with the County details the fees to cover the cost of summoning a jury and the jury trial daily fee which is paid for each case terminated or otherwise concluded after the trial. The previous agreement expired in 2007. The term and fees for the new agreement would be retroactive from May 1, 2013 to December 31, 2015 based on the Seattle CPI -W Index adjustment for inflation, not to exceed 5% annually. 13-53 MOTION BY MIKE MCGOWAN AUTHORIZING MAYOR HARDING TO SIGN AND ENTER INTO THE INTERLOCAL AGREEMENT WITH THURSTON COUNTY DISTRICT COURT FOR FEES TO BE PAID BY THE CITY OF YELM RELATED TO JURY TRIAL COSTS FOR THE PERIOD MAY 1, 2013 - DECEMBER 31, 2015. CARRIED. 9. Old Business — none scheduled 10. Mayor and Council Initiatives Councilmember Isom attended Sustainable Thurston meeting, continue to work on documents to be used by jurisdictions, defining sustainable related to the land use vision. Councilmember Wood reported from the Transportation Policy Board; 'Walk and Roll" walk to school program encourages activity in grade school and working on amendment to bylaws to staggered terms for citizen subcommittees. Mayor Harding reported that the Mayor's forum was cancelled this month. 11. EXECUTIVE SESSION - none scheduled 12.
