a. Ordinance No. 979 Waiver of Water and Sewer Connection Fees for Low
Income Families
Shelly Badger reported that the Washington State Health Code requires
connection to a public sewer service when an on-site sewage system fails and the
public sewer is within 200 feet of the property. In this instance, the City requires
connection to both water and sewer services when both are available.
Washington State RCW 35.92.380 authorizes the waiver of collection of tap -in
charges, connection fees, or hookup fees for low-income persons to connect to
water and sewer lines used by the city to provide utility service. A situation
recently occurred that prompted the City to assess whether a waiver of water and
sewer connection fees would be appropriate. The matter was discussed by the
City Council at their September 25th Study Session and because a septic system
failure and subsequent requirement to connect to the City's sewer and water
systems could place a significant financial burden on households with limited
incomes, the Council agreed to move this item forward for its consideration.
Ordinance No. 979 provides for the waiver of water and sewer connection fees for
low-income households that meet certain requirements. The total maximum
household income of the residents of the dwelling unit shall not exceed 50% of
the most recent Thurston County median household annual income. The dwelling
type must be a detached, single-family residential unit occupied by the owner of
the property. The property owner is required to submit a restrictive covenant
guaranteeing fulfillment of the criteria set forth and a restrictive covenant
requiring the deferred system development charge and meter charge be repaid to

the City in the event the property is sold within 10 years of the date of deferral.
Ordinance No. 979 (Section 3) moves the sewer system development charges
and inspection fee from a previously adopted resolution into ordinance form
providing for consistency between the water and sewer utilities, whereby fees for
all utilities will be codified for ease of reference. There is one correction to the
ordinance on the top of page 5 -$6,394.00 per equivalent residential unit for
development outside local improvement district #1 instead of $6,219.40.

SEWER CONNECTION FEES FOR QUALIFIED LOW INCOME RESIDENTS.

10. Mayor and Council Initiatives
Councilmember Baker attended the Yelm Adult Community Center meeting and
reported about $2,000 was made at the Silent Auction. Councilmember Baker
attended the Intercity Transit Board meeting and stated they are cutting expenses
and cutting back on new developments due to the government shut down.
Councilmember McGowan will be attending the Thurston County HOME
Consortium retreat next Monday.
Councilmember Hendrickson attended the Yelm Emergency Operations Board
meeting where they discussed the interdepartmental functionalities in the event of
an emergency in Yelm.
Mayor Pro -Tem Isom will be attending a listening tour for the Department of
Transportation (DOT) to present our case for the Yelm Loop funding and additional
funding for DOT projects in the South County area.
Councilmember McGowan announced the City of Yelm hired a new Court
Administrator, Sonja Ramirez who comes from the City of Tumwater and starts
Monday, October 14.
