A RESOLUTION OF THE CITY COUNCIL OF YELM, WASHINGTON, DECLARING
THE INTENTION OF THE COUNCIL TO ORDER THE FORMATION OF A LOCAL
IMPROVEMENT DISTRICT FOR THE CONSTRUCTION AND INSTALLATION OF
IMPROVEMENTS WITHIN THE BOUNDARIES OF SAID PROPOSED LOCAL
IMPROVEMENT DISTRICT; SETTING FORTH THE NATURE AND TERRITORIAL EXTENT
OF SUCH PROPOSED IMPROVEMENTS; DESCRIBING THE BOUNDARIES THEREOF;
AND FIXING A DATE, TIME AND PLACE FOR A PUBLIC HEARING ON THE FORMATION
OF THE PROPOSED LOCAL IMPROVEMENT DISTRICT
WHEREAS, the City Council of the City of Yelm, Washington (the "City") has received a
petition for the formation of a local improvement district from a majority of property
owners for street improvements and utilities to serve properties within the proposed
local improvement district, and
WHEREAS, the City Council desires to proceed with the carrying out of said
improvements and to establish a local improvement district in connectioin therewith, and
WHEREAS, the Draft Preliminary Assessments included as Exhibit B have been
prepared based on the number of new trips anticipated from properties within the local
improvement district upon development, and the assessment methodology and actual
assessment may change as long as the assessment does not exceed the increased
true and fair value of that the improvements added to the property; and
WHEREAS, the City Council encourages all persons wishing to comment on the
proposed street and utility improvements and the formation of a local Improvement
district to appear and present such comments or objections at the formation hearing
established by this resolution, and
WHEREAS, after the formation hearing, the City Council may choose to form the local
improvement district as presented, to not form the local improvement district, or revise
the proposed local improvement district after conducting an additional public hearing as
required by law, and
WHERAS, staff from the Community Development Department and from Skillings
Connolly, the consulting engineer, are in the process of a public involvement process
that will continue until the formation hearing and will result in a revised recommendation
on the proposed boundaries and assessment methodology of the local improvement
district prior to the formation hearing,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Yelm,
Washington:
Section 1. it is the intention of the City Council to consider the formation of a
local improvement district for the improvement of the area shown on Exhibit "A" to
complete the following street and utility improvements:
. Improvements to Yelm Avenue West (SR 510) from 93rd to Cullens Road, ;which
include widening the existing roadway section to accommodate sidewalks, a
storm drainage system, planter strips, curb and gutter, illumination, two travel
lanes, bicycle lanes, and a center turn lane.
. Improvements to Killion Road from Yelm Avenue West (SR 510) and the
proposed SR 510 Yelm Loop, which includes widening in order to accommodate
sidewalks, a storm drainage system, planter strips, curb and gutter, illumination,
two travel lanes, bicycle lanes, and a center turn lane.
. A new extension of Killion Road (Tahoma Boulevard) to the south to the
boundary of the Tahoma Terra Master Planned Community to include sidewalks,
a storm drainage system, planter strips, curb and gutter, illumination, four travel
lanes, bicycle lanes, and a center turn lane.
. A traffic signal at the intersection of Killion Roadrrahoma Boulevard and Yelm
Avenue West (SR 510).
Sanitary sewer, potable water, and reclaimed water will be extended and upgraded
throughout the project area pursuant to adopted utility plans.
Section 2. The City shall acquire by gift, purchase, franchise, lease or
condemnation all property, both real and personal, or any interest therein and all rights-
of-way, franchises, permits and easements which may be found necessary to acquire,
construct, and install the above-described improvements.
Section 3. It is hereby further provided that the authorized plan of improvements
shall be subject to such changes as to details of said plan, not affecting the service to
be provided by the plan of improvements, as shall be authorized by the Council either
prior to or during the actual course of construction.
Section 4. The cost of improvements described in Section 1 and costs of interim
notes and bonds shall be assessed against the property specifically benefited by such
improvements, on the basis of the amount of the special benefits to such property. The
assessments shall be for the sole purpose of payment into such local improvement
district bond fund as may be specified by the City Council for the payment of local
improvement district bonds to be issued in part to defray the costs of such
improvements.
Section 5. All persons who may desire to object to such improvements and the
formation of a local improvement district are hereby notified to appear and present such
objections at the meeting of the City Council to be held in the Council Chambers of the
City Hall at 105 Yelm Avenue West, Yelm, WA, at 7:30 PM on May 24, 2006, which time
and place are hereby fixed for hearing all matters relating to said proposed
improvements and all objections thereto and for determining the method of payment of
said improvements. The City Clerk is hereby directed to give notice of said hearing by
publication of this resolution in at least two consecutive issues of The Nisqually Valley
News, which is a newspaper of general circulation within the proposed improvement
district, with the date of the first publication to be at least 15 days prior to the date of
said hearing, and to mail a notice of such hearing setting forth the nature of the
proposed improvements, the total estimated cost, the estimated benefits of
improvements to the particular lot, tract or parcel of land, the time and date of said
hearing, at least 15 days before the date thereof, to each owner or reputed owner of any
lot, tract, parcel of land, or other property specially benefited by said improvements, at
the address shown on the tax rolls of the Thurston County Assessor.
