Mayor Rivas called the meeting to order at 7:30 p.m. Council present: Don Miller, John Thompson, Bob Isom, Glen Cunningham and JW Foster. 2. Agenda Approval 01-61 MOTION BY JOHN THOMPSON, SECONDED BY GLEN CUNNINGHAM APPROVING THE AGENDA AS PRINTED. CARRIED. 3. Public Comment - None Ron Harvey introduced himself as the new Yelm representative to the Thurston Council on Cultural Diversity and Human Rights. Mayor Rivas introduced Carl Provine, American Legion Post 164 Commander, and Veteran's of Foreign Wars member. Mr. Provine introduced Elizabeth Provine, American Legion Post 164, Women's Auxiliary President; Ray Shriver, Commander, VFW Post 5580; Don Barnard, VFW Post 5580 Public Relations Officer and Senior Vice Commander; Bill Jenne, VFW member; and Art Oliver, VFW Post 5580 Service Officer and American Legion member. Speakers provided information on VFW history and projects the organization put its efforts to such as War Risk Insurance, the GI Bill and expansion of benefits to other conflicts, POW and MIA benefits, and the Agent Orange connection. Nationwide the VFW Chapters raise $15 million each year to support service programs. Visible local programs include Voice of Democracy, an annual essay/scholarship program, a junior essay contest, bike safety program, Drive to Survive, Hunter Safety and Home Protection. Women's Auxiliary activities include scholarships, the Espinosa Bear program for children, a meal delivery service serving homebound individuals, and an activities and voucher program at American Lake Veterans Hospital. YELM CITY HALL COUNCIL CHAMBERS preparation at Fisher House, a temporary living facility at Fort Lewis for the families of Madigan Army Medical Center patients. Invitations were extended to attend an upcoming Bratwurst Dinner and a fund raising community fun fair at Yelm City Park. Don Barnard presented elected officials and staff with poppies. Mayor Rivas read and presented a City of Yelm Hire-A-Veteran Month Proclamation, and thanked the group for the community support provided by their organizations and for tonight's presentation to elected officials. 8. Ordinance No. 735, a $100,000 Interfund Loan from the Cumulative Reserve Fund (104) to provide cash flow for the Longmire Community (Canal Rd.) Park Fund (314). Agnes Bennick explained that revenue budgeted is limited to the $234,000 Interagency Committee for Outdoor Recreation (lAC) grant. The fund needs a loan to provide cash flow as grant funds are released only following a city expenditure and request for reimbursement of allowable costs. 01-63 MOTION BY DON MILLER, SECONDED BY BOB ISOM ADOPTING ORDINANCE NO. 735 AN INTERFUND LOAN TO THE LONGMIRE COMMUNITY (CANAL RD) PARK FUND FROM THE CUMULATIVE RESERVE FUND. CARRIED. 9. Resolution 411, Drug and Alcohol Testing Policy for Commercial Drivers License Holders. Shelly Badger explained that currently the only individuals covered by this policy are the drivers of the Senior Center van. The City is part of the Association of Washington Cities testing consortium that provides services to meet federal standards for drug/alcohol testing. The document establishes testing policies for pre-employment, reasonable suspicion, post- accident, random, return-to-duty, follow-up and for re-testing. Discussion topics included testing sites, current CDL holders, concentration levels, applicability to volunteers, possibility of expanding Employee Assistance program to include volunteers in this position. 01-64 MOTION BY DON MILLER, SECONDED BY BOB ISOM APPROVING RESOLUTION 411 A DRUG AND ALCOHOL TESTING POLICY FOR COMMERCIAL DRIVERS LICENSE HOLDERS. CARRIED. 10. Reclaimed Water User Agreement (Fetterly). Shelly Badger explained that this is the first user agreement brought before council. The agreement runs for five years, identifies service as interruptible, and sets out permissible uses, charges, back-flow requirements and restrictions. Discussion topics included interruptible/uninterruptible service, need for a 30- watt heater and billing. 01-65 MOTION BY JW FOSTER, SECONDED BY JOHN THOMPSON APPROVING THE FETTERLY RELCAIMED WATER USER AGREEMENT. None REPORTS 12. Library Report - A written report was provided. Kristin Blalack added that the summer reading program was ready to kick off. John Thompson indicated that the library process is progressing and moving towards a contract. 13 Mayor Rivas a. Mayor Rivas read the Kay Eisenhardt Day Proclamation. Councilmember Foster will represent the City for the presentation. b. Activities included Junior Achievement at Southworth, the 2010 Banquet and award, Mayors' Forum, Audit Entrance Conference, IT meeting, meeting with the Police Chaplin, and the EDC Luncheon. A letter was sent to the south county mayors' representative to the Thurston Co. Medic I Emergency Medical Services Council, requesting an update for Council. 14. Councilmember Activities & Meetings Attended Councilmember Miller attended the Muck Creek Walk an opined that the cleaned parts look great, but the work to keep the grasses under control will be a continuing project. He expressed concern about the restoration plan. He also attended the Chamber Forum, where the speaker was Kim Wyman, the Thurston Co. Auditor. Councilmember Foster attended a Senior Center meeting and was requested to provide a letter in support of their efforts to build a new facility. He also expressed interest in AWC's Elected Officials Training Menu program. All elected officials would like to receive the Land Use Decision-Making training session. Sessions are approximately 2 1/2 hours long. Staff will check for available dates on a council meeting night. Councilmember Isom expressed concern about the three-month time frame for clearing the permitting process, and asked if that was due to a staffing shortage. Shelly Badger indicated that we do have a 120-day timeline for projects. She also indicated that there may be a need for additional help, but also the department reorganization, and number of new projects have a direct impact on the amount of time it takes for staff to complete a project. Mayor Rivas felt that it was good to question this, but that we need to remember to check how long it takes surrounding communities to do the same project while keeping in mind that we are the fastest growing city in the south Puget Sound at 1460/0. We are still coming in under our maximum time, but maybe council needs to look at different department workloads and see what the staffing needs are. He added that Cathie Carlson, the Community Development Director has twice cancelled vacations due to the existing workload. Councilmember Miller reported that everything was in order. 16. Park/Park Use Requests. Discussion topics included the purpose of a $25 fee charged for use of the Yelm to Tenino Trails for organized walks. Following a complaint about the number of special events booked at parks not allowing enough free use time, the Park Advisory Board looked at use and didn't fee that it was excessive. However, the Park Advisory Board's feeling is that these are public parks and they should be used. 01-66 MOTION BY DON MILLER, SECONDED BY JW FOSTER APPROVING TWO PARK USE REQUESTS. CARRIED.
