850 Assessment Reimbursement Amendment CITY OF YELM ORDINANCE NO. 850 AN ORDINANCE UPDATING THE YELM MUNICIPAL CODE RELATING TO ASSESSMENT REIMBURSEMENT CONTRACTS -LATECOMERS AGREEMENTS (CHAPTER 13.12 YMC) AMENDING THE CRITERIA FOR PAYMENT OF A lATECOMERS ASSESSMENT WHEREAS, Chapter 13.12 YMC establishes provIsions for latecomers agreements when a water or sewer line is extended in front of a parcel of land by a developer; and WHEREAS, the existing language on Section 13.12.060 requires a property owner subject to a latecomers assessment to pay the assessment in full at the time of connection to the water or sewer line, and WHEREAS, the intent of this section was to require payment of the latecomers assessment at the time a property re-developed in a manner which triggered connection to the water or sewer system independently of any existing development on the property, and WHEREAS, if an on-site sewage disposal system fails and a sewer line is located within 200 feet of the property, State and County Health Codes, pursuant to Section 246-272A-0025 WAC, require the property to be connected to the sewer system; and WHEREAS, the City of Yelm requires connection to the City water system upon connection to the sewer system; and WHEREAS, a property owner with a failing on-site sewage disposal system would be required to connect to City water and sewer and pay a latecomers assessment even if the property is not being developed, NOW, THEREFORE, THE CITY COUNCil OF YELM DOES ORDAIN AS FOLLOWS: SECTION 1. Amend Section 13.12.060 YMC as follows. No person, firm or corporation shall be granted a permit or be authorized to tap into, or use any water or sewer facilities or extensions thereof that are subject to utility construction reimbursement contract during the period of time prescribed in such contract without first paying to the municipality, in addition to any and all other costs and charges made or assessed for such tap, or use, or for the water lines or sewers constructed in connection therewith, the amount required by the provisions of the contract under which the water or sewer facilities so tapped into or used were constructed. All amounts so received by the municipality shall be paid out by it under the terms of such contract within 60 days after the receipt thereof. Provided. however. that this section shall not applv to the connection of a sinale familv dwellina pursuant to Section 246-272A-0025 WAC. which reQuires connection to a public sewer svstem upon failure of an on-site sewaQe disposal svstem where a sewer line is within 200 feet of the propertv. SECTION 2. This Ordinance shall take effect five days after its publication as provided by law. PASSED by the Cit~ CO~OfYelm this 12th day of July, 2006.
