423 CLAIMS AGENT APPOINTMENT CITY OF YELM RESOLUTION NO. 423 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF YELM WASHINGTON, APPOINTING AN AGENT OF THE CITY TO RECEIVE CLAIMS FOR DAMAGES MADE PURSUANT TO RCW 4.96.020. WHEREAS, the Washington State Legislature passed Chapter 119, Laws of 2001, amending RCW 4.96 to require each local governmental entity to appoint an agent to receive any claim for damages made under said chapter, and WHEREAS, the City of Yelm desires to appoint it's City Clerk as the designated agent for service of claims for damages. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF YELM, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: Section 1. The City clerk is hereby designated as the agent to receive any claim for damages made under RCW 4.96. Section 2. The City Clerk may be reached during the normal business hours of the City at 105 Yelm Ave West, Yelm, Washington 98597. Section 3. If the City Clerk is not available during normal business hours, the City Clerk's designee is appointed as the agent to receive claims for damages. Section 4. All claims for damages against the City made pursuant to RCW 4.96 shall be presented to said agent within the applicable period of limitations within which an action must be commenced. Said claims shall not be effective unless delivered to the agent or designee specified in this Resolution. Section 5. The City Clerk is hereby directed to record a copy of this Resolution with Thurston County Auditor.
