406 Sewer Connection Fees CITY OF YELM RESOLUTION NO. 406 A RESOLUTION READOPTING RESOLUTION 392 clarifying sewer connection fees for lots platted and approved under the original 1994 sewer capacity and establishing an annual increase in the sewer connection fees to ensure adequate funding for debt repayment. WHEREAS, said increases were adopted only after a study of rates demonstrated that a 2.8 percent annual fee beginning January 1,2001 was necessary to maintain the City's ability to repay debt issued on the project and such Resolution was not adopted in an attempt to avoid any . requirement for voter approval of fee or tax increases, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF YELM, WASHINGTON, that Resolution No. 392, a copy of which is attached, be and the same is hereby readopted in its entirety. WHEREAS, the City Council of the City of Yelm has determined that a "Equivalent Residential Unit" (ERU) fee be assessed to fund debt repayment for the upgrade of the wastewater treatment facility to produce Class A reclaimed water, the reclaimed water distribution system and construction of wetlands, and WHEREAS, the debt repayment for the project was estimated assuming a 2.8 percent annual increase (beginning 1-1-2001) of the sewer connection fee. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF YELM, THURSTON COUNTY, as follows: Section I. Equivalent Residential Unit (ERU) Hook-up Fee. I. Development projects and lots platted under the original 1994 sewer capacity as identified in Exhibit "All Development Projects and Lots Platted Under the 1994 Sewer Capacity. $2480.00 per ERU Due at Building Permit Issuance II. The hook-up fee per Equivalent Residential Unit (ERU) for development of lots identified in Exhibit "A" shall be valid for two years from the effective date of this resolution or expiration of their land use approval (whichever is sooner). Upon expiration of the hook-up fee established by this resolution, the new hook-up fee for unpaid capacity commitments for development projects and lots as identified in Exhibit "A" shall be at the amount of the ERU connection fee at the time of this resolution's expiration. Section 2. Hookup fees identified in Resolution No. 380 and 392 will be increased by 2.8 percent per year beginning January 1, 2001 to maintain the city's ability to re-pay debt issued on the project. Section 3. Severability. If any provisions of Resolution No. 392, Resolution No. 380, or their application to any person or circumstance is held invalid, the remainder of the resolutions or the application of the provisions to other persons or circumstances is not affected. Section 4. Effective date. This Resolution shall be in full force and effect from its passage and approval. Passed by the Yelm City Council this 8th day of December, 1999.
