Mayor I-i'arding called the meeting to order at 7:30 p.m. Roll Call. Present: Don Miller, Joe Baker, Bob Isom, Mike McGowan, Pat Fetterly and John Thompson. CARRIED. b. Item moved to after 8b, a. New Business ORDINANCE 859 Killion Road LID #2 Bond Anticipation Notes. Agnes Bennick introduced Jim Nelson, Senior Municipal Underwriter from Martin Nelson & Company to report on the LID #2, providing for the issuance and sale of Bond Anticipation Notes for the purpose of providing interim financing for improvements within the Killion Road Local Improvement District in the aggregate principal amount of $5,100,000 at rate of 4.15% maturing October 2009. Also present was Deanna Gregory representing Cynthia Weed, Bond Attorney from Preston Gates & Ellis LLP who reviewed the Contract to Purchase. Mr. Martin provided background and updated amendments to the draft of this ordinance. MOTION BY BOB 150M ADOPTING ORDINANCE 859 KILLION ROAD LID #2 BOND ANTICIPATION NOTE'2006. CARRIED. . . b. ORDINANCE 860 Public Safety Buildingl Municipal Equipment. Jim . Nelson reported on the process undertaken to rate the City of Yelm for financing the Public Safety Building, providing for the issuance and sale of limited tax general obligation bonds of the City in the principal amount of $4,675,000 to provide funds for a new public safety building and municipal Yelm City Council Minutes clerk/city council/2006/10-24-06 Minutes Approved: 11-14-06 Page 1 of 3 ':'.",;~ , ."<'" machinery and equipment; providing the date, form, terms and maturities of said bonds; deeming final a preliminary official statement; providing for the disposition of the proceeds of sale; and approving the sale -of such bonds. Mr. Martin congratulated staff for being well prepared for the rating presentation with the necessary documents and expertise. Yelm received the highest rating for the smallest city in the State of Washington on their first try. The rating analysis, A, was based on historic and current factors and the purchase of a triple A bond insurance contract resulted in a savings of $153,000 in interest costs. Documents were reviewed by Cynthia Weed, Preston, Bond Attorney, Preston, Gates and Ellis LLP. 06-88 MOTION BY BOB ISOM ADOPTING ORDINANCE 860 ISSUANCE AND . SALE OF LIMITED TAX GENERAL OBLIGATION BONDS FOR FINANCING PUBLIC SAFETY BUILDING AND MUNICIPAL EQUIPMENT. CARRIED. 7. Public Hearing City otYelm Comprehensive Plan Update Mayor Harding opened the Public Hearing at 7.47 pm and asked for a staff report. Grant Beck reported on updating the Comprehensive Plan with an Ordinance for compliance with the Growth ManagementAct and consistency with state and case law. Plan has been developing with public review and scrutiny from 12 other agencies, including, Thurston County Planning Commission and Yelm Planning Commission. The ordinance is to clarify the language without changing the policy. Edward Wiltsie, Olympia, presented a letter to Council with public health and safety issues expressed outside the gUidelines of the Growth Management Act. Concerned that increased level of development allowed within the Plan further jeopardizes traffic safety and ground water issues in the floodplain areas. Recommended educating developers on those sensitive areas and their specific history. Further recommend that the Ordinance . language move to address these issues. Agreed that things that have been done have improved traffic flow some, but broader problem remains that make a new traffic study necessary. Expressed belief that development is needed to pay for improvements but the intent of the plan to tolerate Level F previously is now outdated. Grant Beck stated that Planning is ever changing and the City of Yelm Critical Area Code is stricter than the state guidelines. He added that since 2004, the transportation facility charge collected reached 1.2 million dollars and has been used for the street improvement projects. Mayor Harding closed the Public Hearing at 8:25 with thanks to Mr. Wilksie for his presentation. 06-89 MOTION BY BOB ISOM ADOPTING ORDINANCE 858 AMENDING YELM COMPREHENSIVE PLAN UPDATES CONSISTENT WITH POLICIES OF GROWTH MANAGEMENT PLAN. ", .' . .-' ,~. , .' Business a. Council member Baker reported that Intercity Transit appointed their second new board member, Tom Green. The member's further discussion about raising bus fares was postponed. Councilmember Isom attended Yelm Economic Development Committee meeting where they continued discussion on promotion of commercial areas to select groups. Councilmember.McGowan attended Thurston County Home Consortium Retreat where the committee worked on hammering out bylaws needed to distribute available state and local funds for county wide housing and homelessness issues. Rainier and Bucoda joined with Yelm and Tenino to form a sub-committee for development of advocacy or outreach program to access the available funds. CouncilmemberFetterly attended Fire District meeting. Because she will be unavailable for the next two months, they are asking to have a representative from the City attend in her place. Councilmember Thompson reported meeting with the Transportation Policy Board to get up to speed as a new representative. Has gotten positive feedback regarding Yelm's handling of important issues and ability to work with other agencies in and around Yelm. b. Mayor's Report. Mayor Harding echoed the common theme heard from other groups regarding Yelm as a forward thinking city that works well together within the region. Attended Yelm Economic Development Committee and Thurston County Justice Oversite Committee meeting where they are planning a regional presentation of the look of future facilities. 11. Executive Session. Mayor Harding announced that Council would be going into executive session for 20 minutes to discuss litigation or possible litigation. The audience was excused. Mayor Harding opened the Executive Session at 8:37 pm stating the purpose of the session and moved into the' conference room. After 20 minutes, the time was extended for another 20 minutes to continue the session. Mayor Harding closed the executive session at 9:07 pm 12. Correspondence was available 13.
