586 Public Nuisance PropertiesCITY OF YELM
RESOLUTION NUMBER 586
DECLARING CERTAIN PROPERTIES IN THE CITY OF YELM AS PUBLIC NUISANCES
WHEREAS, the Yelm Municipal Code at Section 9.44.015 states it is a violation for any
person to permit, create, maintain, or allow, upon any premises, acts declared to be a public
nuisance, or to fail to abate such a nuisance.
WHEREAS, the code at Section 9.44.020 YMC describes conditions that are declared to be
public nuisances including trash, litter, filth, unsafe structures, and improper storage of
inoperable and/or unlicensed vehicles ; and
WHEREAS, the Building Official for the City of Yelm has through site visits, photographs,
and conversations with property owners and members of the community, met the definition of
public nuisance as described above; and
WHEREAS, the property owners have been contacted in person and by US mail notifying
them that their property could be declared a public nuisance; and
WHEREAS, some of the property owners are working with the Department, however some
are not; and
WHEREAS, the Planning and Economic Department is requesting the City Council to declare
the properties identified below as public nuisances; and
WHEREAS, the Department will continue to work with property owners in a collaborative
manner if progress on abatement is being made; and
WHEREAS, the City Council has reviewed the properties in question and has determined
that they meet the definition of public nuisance as defined by Section 9.44.020 YMC.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Yelm that the following
properties in the City of Yelm are public nuisances pursuant to Chapter 9.44 YMC and the
Planning & Economic Development Department is authorized to abate the nuisances.
